If you sold a home in 2005 the first step in deciding which column a home buying or selling expense goes under is to take a good look at the RESPA or Real Estate Settlement Proceedures Act form you received at closing or escrow. Take your RESPA and other home buying or selling expenses that you feel might apply to an experienced tax accountant, so they can organize and separate deductions from costs and eliminate non-deductible items. Deferred costs that figure into the basis of a home benefit sellers in the tax year they sold. Some of the out of pocket costs incurred by buyers in the purchase of a home might have to be delayed, which can come as a surprise to buyers.

To claim deductions you must itemize on Schedule A form 1040 and under IRS rules if you itemize you can’t claim the standard deduction. -Recording fees. Fees charge by governments to have mortgages, satisfactions, deeds and other legal documents registered into databases.

-Legal and Abstract fees.

-Property surveys.

-Real estate brokerage commissions.

-Local assessments that increase the value of your property. New sidewalks, streets, sewer and water systems are costs.

-Special homeowners association condominium assessments that cover capital improvements such as a new roof, not roof repairs.

-Charges for installing utility services for new construction.

Don’t plan on taking as a cost or deduction.

-Mortgage principal payments.

-Mortgage insurance premiums.

-FHA and VA funding fees.

-Credit report fees.

-Loan application fees.

-Loan assumption fees.

-Notary fees.

-Mortgage note preparation costs.

-Appraisal fees by mortgage lender.

-Home inspections.

-Moving costs. Unless you relocated to a new job, restrictions apply.

-Cleaning costs when moving in or out of a home.

-Condominium homeowner association assessments.

-Condominium homeowner association application, move-in and move-out fees.

-Rent for occupancy before closing.

-Homeowner’s insurance premiums.

-Wages for household help.

-Depreciation.

-Contributions to a tax escrow accounts that were not paid to a taxing authority.

-The cost of cable-TV, electricity, gas, telephone or water.

-Charges for services such as trash collection or periodic service charges for lawn mowing or snow shoveling when in violation of local ordinances.

-Repairs. An expense that keeps your home in ordinary and efficient operating condition such as fixing gutters leaks, broken windows and cracked drywall.

-Gifts to buyers or sellers such as flowers, gift baskets or entertainment.

-Your own labor for an improvement. An improvement is based on the actual costs of material labor except your own.

Cooperatives offer many tax benefits for homeowners, but they do have special tax rules. Consult a qualified tax accountant who specializes in cooperatives.

The IRS requires that you keep records that affect the basis cost and deductions until the limitations for income tax returns expires, typically a set period of time after you sell your home.

Endorsements, sometimes called “Blurbs,” are wonderful and often witty comments about your book provided by respected authors, journalists, entertainers, and industry experts connected to your topic.     Celebrating the “Day of Deliverance”

    While we Americans do a great job of celebrating with pomp and parade, I can’t help but be struck by Adam’s wishes for the day to be commemorated as “the day of deliverance, by solemn acts of devotion to God Almighty.” I can personally confess to falling way short on that. Games? Got it. Illuminations? Really got it. Picnics with burgers, hot dogs, and ice cream. Oh, yeah.

    But this “solemn acts of devotion to God Almighty ” mandate has thrown me into a public statement of guilt. Oh sure, I do pray solemnly and reverently for those who came before me, who threw themselves into the line of fire to give me freedom. And liberty. And of course the ongoing pursuit of happiness of which we are so addicted. But celebrating July 4th with solemn acts of devotion has never been ingrained into my thinking about the day.

    I love what Paul says about freedom in the book of Galations: “It is absolutely clear that God has called you to a free life. Just make sure that you don’t use this freedom as an excuse to do whatever you want to do and destroy your freedom. Rather, use your freedom to serve one another in love; that’s how freedom grows. For everything we know about God’s Word is summed up in a single sentence: Love others as you love yourself. That’s an act of true freedom. Gal 5:13-14 (The Message)

    As July 4th is celebrated throughout this great country of ours, I will be celebrating my freedom and liberty with my family in another land. We will be vacationing in South America, where, ironically enough, the personal freedoms we have so enjoyed here in the United States are in scarce supply throughout many regions there. Whether or not we will even have access to “illuminations” is in serious debate. The probability of enjoying hamburgers, hot dogs, and ice cream is downright miniscule.

    Wherever you happen to be this July 4th, I hope you take some significant time out of your day to honor John Adams’ wish: commit to spending some portion of your day to “solemn acts of devotion.” Take time out today to pray for our country. Pray for the soldiers on the other side of the world who are currently fighting for others’ freedoms. Pray for their families…that they have peace about their loved ones’ safety and mission there. Pray for our leaders…that, while keeping the courage to stand up for their convictions, they would continue to keep the interests of others at heart as well. Pray for the safety of our citizens…that we be protected from random acts of terrorism and violence. And pray for those who came before us…those men and women upon whose tall shoulders our personal freedom and liberty rest.

    Enjoy the day with your family and serve one another with love. Gather with neighbors for a bike parade. Enjoy your favorite barbequed foods, run through the sprinkler, catch fireflies with your kids, suck ice cream out of the bottom of a cone, and watch fireworks on a blanket in your local park or in your own backyard.

    And promise to be ever mindful today, of your personal freedom, your liberty, and your rights. Be thankful. Pour out a blessing on behalf of those to whom you owe it. Love others. Hug your kids. Hug your spouse. And pat your dog.

    NBA Playoffs Getting Better by the Year

    Let’s recap; there have been 12 series so far, only Dallas vs. Memphis and Detroit vs. Milwakee haven’t extended a stage show. In my opinion these are simply one of the most pleasant playoffs in NBA history.

    The Spurs got all they wanted in the first round from Sacramento. The Heat looked as if they were coming unglued after the Bulls punched them in the mouth in the opening round. But Miami survived and has since thrived.

    I think Phoenix vs. Lakers’ first round with Kobe Bryant making those wonder shots in Game 4 giving Lakers a three game lead followed by Raja Bell’s suspension for running into Bryant and Barboza’s excellent performance in filling in for Bell in Game 6, opening way for Game 7.

    Miami beat New Jersey in five games, the last three of which were undecided with two minutes to go in each game. And then there are the Clippers, who are unbelievable. To see the Clippers take over the city of Los Angeles is simply fulfilling. They have been the worst team in NBA for the past 25 years, and yet there they are.

    All this makes this season compelling for most members of the family and makes the NBA playoffs create the stars that make people watch in following years.

    Father’s Rights

    Yeah, right. There is such a thing as “Father’s Rights” in the Family Court System, I
    just haven’t seen it. Father’s need to take matters into their own hands when it
    comes to gaining custody of their children.

    Such was the case with Darren Jones. He had a great relationship with his daughter,
    a wonderful job and a beautiful wife. Until one day his wife decided she wanted
    nothing to do with him, and made that same decision for their daughter.

    All Mr. Jones had to do was file divorce papers, claim that the father had been a
    non-existent part of their daughters life, and demand custody. Without any proof,
    the mother was then given an order for custody, and Mr. Jones was relegated to
    seeing his beloved daughter every other weekend.

    Mr. Jones set out on his journey to get back his child, but found that the courts do
    not simply hand ANYTHING over to men. In fact, he realized the expensive lawyer he
    had hired thought his job description was to stall the whole issue as long as he
    could, as did Mrs. Jones’ representation.

    Each court hearing yielded the same results. NOTHING. Every time he walked out of
    the courtroom, the feeling of desperation became more and more overwhelming. At
    many times in his battle, he thought long and hard about giving up. “What’s the
    use?” He thought, “Nothing will ever change.”

    Years went bye, and as his daughter aged, his time became less and less with her.
    After time, her mothers alienation techniques began to work, and his daughter
    ended up seeing him a week or two in the summer, and that was it.
